GENERAL TERMS AND CONDITIONS OF SALE

Preamble
These General Terms and Conditions of Sale (hereinafter "T&Cs") apply to all sales concluded on the Decléor website, accessible at https://decleor.com (hereinafter "the Site").

The Site sells cosmetic care and aromatherapy products from the Decléor brand.
By placing an order on the Site, the customer acknowledges having read these T&Cs and accepts them without reservation.
Article 1 — Purpose and Scope
These T&Cs define the rights and obligations of the parties within the framework of the online sale of products offered on the Site.
They apply to any order placed by a consumer (hereinafter "the Customer") residing in mainland France and Corsica. For any delivery to the overseas departments and territories (DOM-TOM) or abroad, please contact us for a personalized quote.
COSPAL reserves the right to modify these Terms and Conditions of Sale (T&Cs) at any time. The applicable conditions are those in effect on the date the order is confirmed.
Article 2 — Products
The products offered for sale are those presented on the Site, subject to available stock.
Each product is accompanied by a detailed description. Photographs illustrating the products are not contractually binding. In the event of a clear error between the product characteristics and its representation, COSPAL cannot be held liable.
Article 3 — Prices
Product prices are indicated in euros, all taxes included (TTC), excluding delivery fees.
Delivery fees are indicated before the final confirmation of the order and are charged in addition to the product prices.
COSPAL reserves the right to change its prices at any time. Products are billed based on the rates in effect at the time the order is confirmed.
In the event of the creation or modification of taxes or contributions, these may be passed on to the product sale price.
Article 4 — Order
4.1 Placing an Order
To place an order, the Customer selects the products of their choice and adds them to their cart. They then access their cart to verify the details of their order and the total amount.
The Customer provides their delivery and billing details, chooses their delivery method, then proceeds to payment.
The order is only definitively confirmed after payment confirmation. A confirmation email summarizing the order is then sent to the Customer.
4.2 Modification and Cancellation
Any request for modification or cancellation must be sent as soon as possible to contact@cospal.fr. COSPAL will make its best efforts to comply, without guarantee if the order has already been shipped.
4.3 Order Refusal
COSPAL reserves the right to refuse or cancel any order in case of:
- Dispute related to payment of a previous order
- Legitimate reason, especially in case of suspected fraud
Article 5 — Payment
5.1 Payment Methods
Orders are paid by credit card (Visa, Mastercard, American Express) via a secure payment platform.
The total order amount is debited at the time of validation.
5.2 Payment Security
Transactions are secured by our payment provider. COSPAL never has access to the Customer’s full bank details.

Article 6 — Delivery
6.1 Delivery Areas and Times
Deliveries are made in mainland France and Corsica.
Delivery times are indicated at the time of order and start from payment confirmation. For reference:
- Standard delivery: 3 to 5 business days
- Express delivery: 24 to 48 hours
These timeframes are indicative and may vary depending on product availability and the carrier.
6.2 Order Receipt
The Customer agrees to check the condition of the package upon receipt. In case of anomaly (damaged package, missing or damaged product), the Customer must:
- Make written reservations on the delivery slip
- Refuse the package if necessary
- Notify COSPAL within 48 hours by email at contact@cospal.fr
6.3 Absence at Delivery
In case of absence, a delivery notice will be left allowing the package to be collected according to the carrier’s terms.
Any package returned due to incorrect address or unclaimed will be resent at the Customer's expense.
Article 7 — Right of Withdrawal
In accordance with articles L.221-18 and following of the Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify reasons or pay penalties.
7.1 Terms of Exercise
To exercise this right, the Customer must notify their decision by:

The Customer may use the withdrawal form below or any other unambiguous statement.
7.2 Product Returns
Products must be returned in their original condition and packaging, complete and unused, within 14 days following the withdrawal notification.
Return shipping costs are the responsibility of the Customer, except in case of an error by COSPAL.
7.3 Refund
COSPAL processes the refund within 14 days from the receipt of the returned products or proof of shipment, whichever comes first.
The refund is made using the same payment method used for the order.
7.4 Exclusions
The right of withdrawal cannot be exercised for products unsealed after delivery and that cannot be returned for hygiene or health protection reasons (article L.221-28 of the Consumer Code).

Article 9 — Legal guarantees
All products sold on the Site benefit from the legal guarantees provided by the Consumer Code:
9.1 Conformity warranty (articles L.217-4 to L.217-14)
The Client can request repair or replacement of the non-compliant product. If these solutions are impossible, the Client can return the product and obtain a full or partial refund.
9.2 Hidden defects warranty (articles 1641 to 1649 of the Civil Code)
The Client can choose between canceling the sale or a price reduction if the product has a hidden defect making it unfit for use.

Article 11 — Mediation
In accordance with the provisions of the Consumer Code relating to amicable dispute resolution, the Client can use the mediation service offered by COSPAL free of charge.

Before contacting the mediator, the Client must have previously attempted to resolve the dispute directly with COSPAL through a written complaint.

Article 12 — Personal data
12.1 Data controller
COSPAL, as the data controller, collects and processes the Client's personal data.
12.2 Data collected
- Identification data: last name, first name, email address, postal address, phone number
- Connection data: IP address, browsing data
- Transaction data: order history, payment data
12.3 Purposes of processing
- Order and customer relationship management
- Product delivery
- Payment management
- Sending commercial communications (with consent)
- Improvement of our services
- Fraud prevention
12.4 Legal basis
Processing is based on contract execution, Client consent, or COSPAL’s legitimate interest.
12.5 Recipients
Data may be transmitted to COSPAL’s service providers (logistics, payment, hosting) strictly within the scope of service execution.
12.6 Retention
Data is retained for the duration of the commercial relationship and up to 3 years after the last contact, unless a longer legal retention period applies.
12.7 Client rights
In accordance with the GDPR and the Data Protection Act, the Client has the following rights:

Article 13 — Cookies
The Site uses cookies to improve user experience, generate statistics, and offer personalized content.

Article 14 — Intellectual property
All elements of the Site (texts, images, logos, trademarks, etc.) are protected by intellectual property rights.
Any unauthorized reproduction, representation, or exploitation is prohibited and constitutes counterfeiting punishable by law.
Article 15 — Force majeure
COSPAL cannot be held responsible for failure to perform its obligations in case of force majeure, as defined by Article 1218 of the Civil Code and French case law.
Force majeure events include, in particular: natural disasters, strikes, pandemics, transport blockages, interruption of telecommunication networks.
Article 16 — General provisions
16.1 Entirety
These Terms and Conditions express the entire obligations of the parties.
16.2 Partial invalidity
If any clause of the Terms and Conditions is declared null, the other clauses remain fully valid.
16.3 Non-waiver
COSPAL's failure to invoke a breach by the Client does not constitute a waiver of the right to invoke it later.
Article 17 — Applicable law and jurisdiction
These Terms and Conditions are subject to French law.
In case of dispute, an amicable solution will be sought prior to any legal action.
In the absence of an amicable agreement, French courts shall have exclusive jurisdiction.
